Klum and Elle Macpherson Wrestle for ‘The Body’
There
can be only one! Both supermodels consider themselves
entitled for “The Body”. An expensive, legal
battle could actually issue if Macpherson has copyrighted
her long-held title.
Klum
has recently launched a bra called “The Body”.
“They call me The Body, and now I have one named
after me” Klum claims in American TV ads for
the lingerie.
“It's
a big honor having a bra named after my nickname that
people know in the business.”
Other
advertising materials picture Klum beside a huge sign,
shamelessly reading “Introducing The Body”.
"We
have press clippings and newscaster reports for nearly
10 years calling Heidi The Body. Who are we to argue
with the media?" says Ed Razek, Victoria secret’s
CEO.
"Elle
Macphearson Intimates", Macphearson’s own
lingerie line is outraged. She has ruled under the
title “The Body” since 1986 when Time magazine
labeled her like that in a cover story.
A
spokesperson for MacPherson's fashion line tells the
New York Daily News, "We saw that and were like,
'Oh my god!' We were initially flabbergasted. We have
numerous press clippings in the office referring to
her as 'The Body'. Everything from Harper's Bazaar
to Vogue to the recent Sports Illustrated calls her
that. In terms of public record, that name belongs
to Elle."
Aussie
Macpherson has made a career by being the original
'Body', and it was her who used her body as a brand
for the first time, not Heidi Klum. Even now, after
two births, at the age of 43, she shows no signs of
slowing.
Ed
Razek on the other hand claims that the Aussie model
can’t keep the title forever and should step
aside.
"You
cannot say that using the name 'The Body' for a bra
is passing yourself off as the nickname Elle Macpherson
has. If Ms Macpherson has copyrighted her moniker
under intellectual property laws she could in theory
start legal proceedings-but she would pay out a great
deal more than she would potentially make from the
case," copywriting expert Arthur Pottersman said.
"It simply would not be worth it," he added.
